I was in a car accident 4 days ago. My Mother was the passenger in my car (I was driving). I was on the off ramp getting off the freeway. All cars behind me were stopped. I was stopped waiting to make a right turn. An emergency vehicle was coming in my direction from my left. Therefore, I was waiting for the emergency vehicle to pass. The person behind me (large dodge ram truck I am in an '08 2 door Infiniti coupe) thought I went so he 'gunned it' to get in front of the emergency vehicle. Unfortunately, we had not gone so he pushed my vehicle out in front of the emergency vehicle. Luckily, I was able to turn my car out of the way. I did not hit anyone (no one was in front of me). My Mother and I were both put into a gurney and taken to a local hospital in an ambulance. We both had our seat belts on and suffered whiplash. We were released 5-6 hours later after x-rays, etc. We were both prescribed medicine. My Mother has had 3 brain tumors and has trouble with her speech etc. and any violent startling trauma can get her shaken up pretty badly and confused. I know she hit her head but, she is in pain but not nearly as much as I am. With my Mother's condition I don't know if this kind of thing can have negative effects later on. I know that my neck and back is pretty messed up. It hurts to stand for after 15 minutes or so. My car is pretty messed up and had to be towed. I plan on taking it back to the Infiniti shop to get all new parts. My car has all the upgrades in it so I want it to be taken care of. Am I allowed to take it to the Infiniti dealership or will Geico (the other persons insurance) not allow that, or does it not matter? The police gave the guy that hit us a citation. I have USAA and the other person has Geico. I just want to know exactly what to do in this situation. Since I'm out a car (I work for myself) I have been out (already) a decent amount of money for not being able to meet up with my clients. I spoke to my insurance today and they said that all my medical is covered since I had that already in my plan (without it raising my premium) and that I should get a settlement ON TOP of paying for damages to my car and getting me a rental, etc. Any advice would be greatly appreciated. I don't want to get taken for a ride. I've heard the horror stories of dealing with insurance companies. Any advice on what I should make a point of saying to the other insurance company, etc. Thanks in advance....

I'm currently with Progressive and have been very pleased with their service: I was in an accident in August and the entire process was very smooth and took little effort on my part. I worked with one local agent, dropped my car off at the Progressive repair center where they had my rental waiting for me, and returned the rental there when I came to pick my car up. Plus I never have to wait long to talk to someone when I call. However, I'm newly married and have found we would save a considerable amount by moving my two cars to my husbands policy with State Farm as opposed to moving his car to my policy with Progressive. I am 16 years old and State Farm is calling me and it is getting annoying. I don't own a car and I don't drive much. When I do drive I borrow the car that is under my sister's name. Okay... I was driving my parents car to work. I am 19. No tickets or crashes since I was 15 and a half. I was rear ended when I stopped for an ambulance. My parents have insurance on that car, but I am not on their policy. I did have my mother's permission to use the vehicle. I had to call them yesterday just to get them to read my accident report, and accept liability. They hadn't even contacted the policy holder! They told me that they would set me up with a rental car, and cover the fees. Today I went to Enterprise to pick up the rental car and was asked if the insurance company (USAA) had mentioned anything about a underage bracket fee. When I told them that they hadn't, the woman at enterprise contacted USAA. It was then that they stated that they would not pay for the underage fee (I am 19), which is about $22 per day. Naturally, I was completely outraged. Both my insurance company and USAA's offices are closed at this time, so I have to wait until tomorrow to contact them. I was told by my agent that because the accident wasn't my fault, ANY cost that is a result of the accident MUST be covered by the other driver's insurance company. What can I do about this? I don't have the money to pay for the fee, but I need the transportation. I've already been without transportation for a week.

What are legal steps to resolving an auto insurance claim?

Allstate was supposed to compensate me for X amount of damage done to my car by the driver who had insurance upto 5 grand. Notice that I did not have insurance with AllState but that because the driver was at fault, and had coverage of upto $5000, AllState has agreed to pay me a portion of that 5 grand. However, the problem is the driver who was at fault is not agreeing to this and demands more in loss from AllState. Whereas, although, I myself deserve more in damage since the car was worth more than the amount I am being compenstated for, I have still decided to settle for less. Now because the driver is delaying the decision to accept the remaining amount out of 5 grand, this case/claim has not resolved SINCE 2010. They wouldn't send me check yet only because the driver needs to accept the offer also. My theory is that whether or not the driver finds the offer fair, is none of my problem. I shouldn't have to wait for 2 years only because the driver refuses their offer. I should get my share at least. Do I have a legal case against the company for taking too long in this regards ? What can I do to resolve this ?

Ok here's the deal. I financed a car through a dealership (1st time buying a car) and got completely taken. I didn't understand the paperwork, and the person selling told me that the GAP insurance would take care of me if the car was totaled. My car was hit while it was parked in my own driveway 4 days ago (in NY state). The police came and filed a report. I asked them for the other drivers insurance info, but they said I would have to wait for the police report and it would include that information. They advised it would be available after 5 business days at a cost of $5.00. I think the information should have been made available immediately so I could have filed a claim with the other person's insurance company. I don't suspect they will get rich by charging $5.00, so I don't know why I have to wait for the info. I am concerned that the other person's insurance will question the delay in filing the claim. Is this normal? I would really like to get my car fixed as soon as possible and am frustrated that I have to wait to get information that I think should have been immediately available. The driver that hit my car admitted to being on heavy duty prescription drugs at the time of the accident, but said that wasn't the cause of the accident. They said they had a seizure and had a documented history of seizures (which makes me think they shouldn't have a valid license anymore). The police seemed suspicious, but said they wouldn't issue any tickets as long as the person agreed to go to the hospital for treatment of seizures. There were no injuries, but there was significant damage to several parked vehicles, and minor damage to several homes and other property that was hit . Thank you to all that answer.

I just graduated with a bachelors degree, and my student health insurance runs out in August. The health insurance offered by my husbands job (which won't open up to me until Jan.1 anyway) considers pregnancy a pre existing condition, and won't cover it. We have been searching for affordable plans, but the only ones we have found that will cover pregnancy aren't accepted in New York state. For all the plans offered in NY that we've been able to find, none cover pregnancies in progress. I would hate to have to use the state provided health care plan for pregnant mothers (mostly because I feel like there is no reason for me to be part of a government program when we are capable of paying for our own insurance, but also because it means we have to go to specific clinics and I won't be able to keep my doctor), but there is no way we will be able to cover all the costs of a birth, especially if for some reason I need a C-Section or the like. Can anyone give me some advice, especially as it relates to the NY state health plan for pregnant women?

I just got my M1 license and I've enrolled myself into a motorcycle course which would help me earn my M2 by the end of September. I've discussed getting a mustang to my family and friends for quite a while now. I know the downsides, high insurance, bad gas mileage, and too much power(according to my parents). I'm a big fan of the foxbody('79-'93) mustangs and I also really want a V8 and I also want stick if that matters. The way I see it, I'm going to pay a lot for insurance no matter what, so why not pay a little bit more and pay for the car I really want.
